Email: lorenz@fba-easy.de
Phone: +49 176 83089316
regarding the purchase of digital services, such as product images, A+ content design, Ad Campaigns and other content related services.
2. Conclusion of Contract
The presentation of services on our website does not constitute a legally binding offer. By placing an order request, the customer submits a binding offer. The contract is concluded once we confirm acceptance of the order in writing (e.g. by email).
3. Scope of Services
We provide digital services according to the individual agreement with the customer. This includes, but is not limited to, product photography, graphic design, content creation and ads management.
Delivery is made digitally (e.g. via email, download link, or shared folder). No physical shipping takes place.
4. Prices and Payment
All prices are stated in USD and include statutory VAT where applicable.
Payment methods include bank transfer, credit card, PayPal, or Stripe, unless otherwise agreed.
Unless otherwise agreed, payment is due in advance upon conclusion of the contract.
5. Delivery of Services
The agreed delivery time begins after receipt of payment and provision of all required customer information (e.g. product samples, texts, brand guidelines).
Delivery takes place digitally within the agreed timeframe. Delays caused by late provision of customer information are not our responsibility.
6. Customer Obligations
The customer must provide all necessary information, documents, and files in a timely manner.
The customer confirms that they hold all necessary rights to materials provided (e.g. logos, texts, images).
7. Usage Rights & Intellectual Property
Upon full payment, the customer receives the non-exclusive, transferable right to use the created materials for the agreed purpose (e.g. Amazon listing, website).
We retain the copyright to all work until full payment has been received.
Any use beyond the agreed scope requires our written consent.
8. Right of Withdrawal
Consumers in the EU have a statutory right of withdrawal. However, this right may expire prematurely if we have already fully provided the service with the customer’s prior express consent and acknowledgment that the right of withdrawal is waived once the contract has been fully performed.
Details are set out in our Withdrawal Policy.
9. Warranty and Liability
Statutory warranty rights apply.
We are not liable for the success of third-party approvals (e.g. Amazon product listings, ad performance) as these depend on external factors beyond our control.
In all other respects, our liability is limited to foreseeable damages typical of the contract in the case of slight negligence.
10. Governing Law and Jurisdiction
Contracts are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For business customers, the exclusive place of jurisdiction is Erfurt, Germany. For consumers, the statutory rules on jurisdiction apply.
